Terms of Service

By downloading, installing, accessing, or using MOSA (the 'Service'), you agree to be bound by these Terms of Service ('Terms'). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you ('User', 'you') and Talivio Technology OÜ ('Company', 'we', 'us'). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. We reserve the right to modify these Terms at any time. Material changes will be notified through the Service or via email. Continued use after changes constitutes acceptance.

2.1. MOSA is an offline mesh communication system that enables users to communicate without internet or GSM networks using: • Standard smartphones (BLE Mesh) • Gateway devices (LoRa, FSK protocols) • Internet Gateway services (optional, for bridge features) 2.2. Service Components: • MOSA Core: Free, unlimited mesh messaging • Bridge Services: Optional premium features (WhatsApp/Telegram bridge, media sending, cloud backup) • Gateway Hardware: Physical devices sold separately 2.3. Service Availability: • The Service is provided 'as is' and 'as available' • We do not guarantee uninterrupted availability • Service may be unavailable due to maintenance, updates, or technical issues • Mesh network coverage depends on device proximity and Gateway availability

3.1. Age Requirement: • You must be at least 16 years old to use MOSA • If you are under 18, you must have parental consent • Users under 16 are not permitted to use the Service 3.2. Account Registration: • Basic mesh communication does not require account registration • Bridge services require account creation with email address • You are responsible for maintaining account security • You must provide accurate information 3.3. Account Termination: • You may delete your account at any time • We may suspend or terminate accounts that violate these Terms • Account deletion results in permanent loss of associated data

4.1. Lawful Use: You agree to use MOSA only for lawful purposes and in accordance with: • These Terms • Applicable laws and regulations • EU and Estonian laws • International laws (where applicable) 4.2. Prohibited Activities: You may NOT: • Use the Service for illegal activities or to facilitate illegal activities • Transmit harmful, abusive, threatening, defamatory, or offensive content • Violate intellectual property rights • Attempt to compromise network security or integrity • Reverse engineer, decompile, or disassemble the software (except as permitted by law) • Use automated systems to access the Service without authorization • Interfere with or disrupt the Service or servers • Impersonate others or provide false information • Collect or harvest user data without consent • Use the Service to spam or send unsolicited messages 4.3. Emergency Services: MOSA is NOT a replacement for emergency services. Do NOT rely on MOSA for critical emergency communications. Always use official emergency services (112 in EU) for life-threatening situations.

5.1. Our Rights: • MOSA software, documentation, and related materials are protected by copyright, trademark, and other intellectual property laws • Talivio Technology OÜ owns or licenses all rights in the Service • The ACFR (Adaptive Congestion-Free Routing) algorithm is proprietary technology 5.2. License Grant: • We grant you a limited, non-exclusive, non-transferable, revocable license to use MOSA • This license is for personal, non-commercial use unless you have a commercial license • You may not sublicense, sell, or distribute the software 5.3. Open Source Components: • Some components are licensed under open source licenses (GPL-3.0, MIT) • Open source components are subject to their respective license terms • You must comply with all applicable open source license terms 5.4. User Content: • You retain ownership of content you create using MOSA • By using the Service, you grant us a license to process your content as necessary to provide the Service • You are responsible for ensuring you have rights to any content you transmit

6.1. Subscription Plans: • Bridge Unlimited: €19.99/month (or equivalent in local currency) • Bridge Pro: €49.99/month (or equivalent in local currency) • Prices are subject to change with 30 days' notice 6.2. Payment Processing: • Payments are processed through third-party payment processors (App Store, Google Play, or direct payment) • You are responsible for payment method validity • Failed payments may result in service suspension 6.3. Refunds: • Refunds are handled according to App Store/Google Play policies • Direct payments: Refunds may be available within 14 days of purchase, subject to our refund policy • No refunds for partial months or unused portions 6.4. Cancellation: • You may cancel your subscription at any time • Cancellation takes effect at the end of the current billing period • No refunds for the current billing period

7.1. Service Disclaimer: THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: • Warranties of merchantability • Fitness for a particular purpose • Non-infringement • Uninterrupted or error-free operation • Message delivery guarantees • Network coverage guarantees 7.2. Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW: • We are not liable for indirect, incidental, special, consequential, or punitive damages • Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim • We are not liable for: - Delayed or undelivered messages - Loss of data - Service interruptions - Consequences of relying on MOSA for critical communications - Third-party actions or content 7.3. Emergency Communications: MOSA IS NOT DESIGNED FOR CRITICAL EMERGENCY COMMUNICATIONS. DO NOT RELY ON MOSA FOR LIFE-THREATENING SITUATIONS. ALWAYS USE OFFICIAL EMERGENCY SERVICES.

You agree to indemnify, defend, and hold harmless Talivio Technology OÜ, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: • Your use of the Service • Your violation of these Terms • Your violation of any law or regulation • Your infringement of any third-party rights • Content you transmit through the Service

9.1. Your Right to Terminate: • You may stop using the Service at any time • You may delete your account and uninstall the app 9.2. Our Right to Terminate: • We may suspend or terminate your access if you violate these Terms • We may discontinue the Service with 30 days' notice • We may terminate accounts that are inactive for extended periods 9.3. Effect of Termination: • Upon termination, your right to use the Service ceases immediately • We may delete your account and associated data • Provisions that by their nature should survive termination will remain in effect

10.1. Governing Law: These Terms are governed by and construed in accordance with: • Estonian law • EU law (where applicable) 10.2. Jurisdiction: • Disputes shall be resolved in Estonian courts • Harju County Court (Harju Maakohus) has jurisdiction 10.3. Alternative Dispute Resolution: • We encourage resolution through direct communication • EU Online Dispute Resolution Platform: https://ec.europa.eu/consumers/odr • Estonian Consumer Protection Board for consumer disputes

11.1. Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Service. 11.2. Severability: If any provision is found unenforceable, the remaining provisions remain in effect. 11.3. Waiver: Our failure to enforce any right does not constitute a waiver. 11.4. Assignment: You may not assign these Terms without our consent. We may assign these Terms to any successor or affiliate. 11.5. Force Majeure: We are not liable for failures due to circumstances beyond our reasonable control. 11.6. Language: These Terms are provided in English, Turkish, and Estonian. In case of conflict, the English version prevails.

13.1. Apple App Store: If you download MOSA from the Apple App Store, the following applies: • These Terms are between you and us, not Apple. • Apple has no obligation to provide support or maintenance for MOSA. • In case of any failure of MOSA to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for MOSA to you (if applicable); and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to MOSA. • Apple is not responsible for addressing any claims by you or any third party relating to MOSA or your possession and/or use of MOSA, including, but not limited to: (i) product liability claims; (ii) any claim that MOSA fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation. • Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim. • You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a 'terrorist supporting' country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. • You must comply with applicable third-party terms of agreement when using MOSA. • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of complying with these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof. 13.2. Google Play: If you download MOSA from Google Play, you agree to Google Play's Terms of Service.
